This Privacy Policy (the “Policy”) sets forth the principles under which ProVal AI, LLC, a California limited liability company (“ProVal AI”, “Company”, “we”, “us”, or “our”), collects, processes, stores, and protects the personal data of individuals (“User”, “you”, or “Data Subject”) in connection with the access and use of the ProVal AI software-as-a-service platform (“Platform”).
Controller Identification
ProVal AI, LLC shall be deemed the Data Controller for purposes of this Policy. All inquiries may be directed to: privacy@proval.ai.
Data Protection Officer
The Company is not required under applicable data protection laws to appoint a Data Protection Officer (“DPO”). However, a designated representative may be contacted at the above email address.
Categories of Personal Data Processed
The Company may collect and process the following categories of Personal Data:
- Identity Information (e.g., name, email address, employer).
- Authentication Credentials (e.g., usernames, hashed passwords).
- Technical and Usage Information (e.g., IP address, access logs, browser metadata).
- Transactional Data (e.g., billing history, payment confirmations).
Legal Bases and Purpose for Processing
Processing activities are carried out under the following legal bases, in accordance with Article 6 of the GDPR:
- Contractual Necessity: for account registration and service delivery.
- Legal Obligation: for compliance with applicable laws.
- Legitimate Interest: for platform improvement and fraud prevention.
- Consent: for optional features and marketing communications.
Recipients of Personal Data
Personal Data may be shared with the following recipients or categories of recipients, solely as necessary to fulfill the purposes set forth herein:
- Cloud Infrastructure Providers (e.g., AWS, Azure).
- Payment Processors (e.g., Stripe, PayPal).
- Analytics and Monitoring Tools.
All third-party processors are contractually bound by data protection agreements to maintain confidentiality and security.
International Data Transfers
Transfers of Personal Data outside the European Economic Area (“EEA”) shall be made in accordance with applicable law, including the use of Standard Contractual Clauses (SCCs) and equivalent safeguards.
Retention of Personal Data
Personal Data shall be retained for the duration necessary to fulfill the stated processing purposes, or as otherwise required under applicable law. Data will be securely deleted upon termination of the User’s account in accordance with Company’s internal retention policy.
Data Subject Rights
Pursuant to Chapter III of the GDPR, Users have the following rights, subject to verification and applicable exceptions:
- Right of Access.
- Right to Rectification.
- Right to Erasure (“Right to be Forgotten”).
- Right to Restriction of Processing.
- Right to Data Portability.
- Right to Object.
- Right to Withdraw Consent.
Consent Withdrawal and Objection
Where processing is based on consent, such consent may be withdrawn at any time without affecting the lawfulness of prior processing.
Automated Decision-Making
The Platform does not employ automated decision-making or profiling that produces legal effects.
Security Measures
The Company employs reasonable technical and organizational safeguards, including but not limited to encryption, access control, intrusion detection, and monitoring to ensure the confidentiality and integrity of Personal Data.
Cookies and Related Technologies
The Platform utilizes cookies and similar tracking mechanisms for the purposes of session management, analytics, and user experience enhancement. Details regarding the types and uses of such technologies are provided in the Company’s Cookie Policy.
Amendments
The Company reserves the right to amend this Policy at any time. Material changes will be communicated via email or platform notification.
Supervisory Authority
Data Subjects located within the EEA or the United Kingdom may lodge complaints with their respective Supervisory Authorities.
